Alienation of Waqf Property :- As per Section-51 of the Waqf Act 1995 (Amended 2013), the Waqf property neither can be sold out nor can be given in gift nor it can be mortgaged or exchanged. An illegal encroachment and transfer over Waqf property is a penal Act and for this there is a provision for two years of imprisonment to the persons who is involved in illegal sale or purchase of the Waqf land. The Board taken action and lodges FIR as per Section 52-A of Amendment Act 2013 against persons of illegal seller & purchaser of Waqf Property.
Status of Registration of Waqf: The registration of Waqf properties are being done U/S26 of the Waqf Act 1995 (Amendment 2013). So far the Bihar State Shia Waqf Board has registered 262 Waqf Estate and the process of registration is always continuing. For this purpose the registration form along with all the documents and proofs regarding the land as such Waqf Nama, Khatiyan, rent receipts are required to be submitted in the Board office. After the enquiry it is registered and a registration certificate is issued. Masjid, Qabristan Karbala, Imambara, Eidgaah, Dargah, is Deen to be Waqf as Waqf by user.
Status of Survey of Waqf Properties:- The State Govt. (Revenue & Land Reforms Deptt.) by its Notification No.-175, dated 01-02-2001 & letter on The Minority Welfare Department by its Notification No.-843, dated 15-09-2008 has appointed the Principal Secretary Revenue and Land Reforms Department as survey commissioner, the collectors of the districts as Additional Survey Commissioner and all the D.C.L.R as Assistant Survey Commissioner to get the Waqf Properties surveyed U/S 4 of the Waqf Act, 1995.
The total Waqf record and other information send to the revenue Department for survey of Shia Waqf Property.
The Principal Secretary-cum-Waqf Survey Commissioner directing to all District Magistrate vide its Letter No.-8/Waqf B0Bhu0 Survey-03-01/2014-61(8),dated 13-03-14 to complete the Survey of Waqf within one year positively.
